i recently discovered the BYU discussion board on facebook and let me tell you -- RARELY does a little corner of the internet bring me so much mirth and enjoyment.

seriously.. it doesn't get much better than a bunch of college freshmen trying to rationalize why the mormon church didn't let black people become bishops until well into the 70s. or hearing a "hardcore libertarian" defend a school "honor code" that mandates when you shave and cut your hair.

its almost enough to make me want to vote for mitt romney.

i think like at least 50% of the preparation that law school actually gives you for the law is making you believe that going to work (or school in this case) at 8am and not leaving until 11pm at least once or twice a week isn't strange at all and is, in fact, to be expected.

on the availability of damages for emotional distress for breach of contract...

"While many courts insist that the breach [of contract] amount to a tort, other courts are equally insistent that the willful, wanton or insulting conduct need not amount to a tort. See, e.g., Trimble v. City & County of Denver

In this case, Dr. Trimble, Director of Medical Services at a Denver hospital, was under the supervision of a Dr. Kauvar. Dr. Kauvar developed a personal animosity toward Trimble and abused his administrative power in a malicious fashion to 'get rid' of Trimble, finally implementing a regoranization that left Trimble with his original title but relocated to an office in the maintenance building known as the 'boiler house,' with no assignment to his normal duties other than to proctology - 'not his specialty of choice.'"

today in class.

professor birke: i was talking to an insurance adjuster guy and asked him what his routine case was like and he thought for a moment and said,

ins. adjuster: what like.. a factory explosion or something?

prof birke: that's a routine case?

ins. adjuster: well. im on the property team at work. there's like four of us that only handle explosions.

...

another choice quote from an ins. adjuster: man i was lucky to get away with only 9 figures with that case.

lol

i've recently had cause to write a lot of cover letters. not to offend or shock the lovers of cover letters out there, but i'm not embarrassed to admit that i don't really enjoy writing them.

having had the opportunity to write so many i've been thinking about their function in society. the conventional wisdom is that when applying for a job you should write a "personalized" cover letter to go along with your application. said wisdom states that doing so shows whatever hr drone reviews your application that you have a personal interest in the job and, therefore, you are the Right Man for the JobTM.

of course, none of these things are really personalized beyond whatever it takes to create the APPEARANCE that is is not a mass cover letter. further, the structure of these things is highly formulaic as well.

the content of the opening paragraph, if not the opening sentence is dictated by custom. as is the second as well as the third and final closing paragraph.

in all, i can't help but be reminded of the "eight-legged" essays that hopeful chinese civil servants used to be compelled to write to prove they had the chops for their jobs. supposedly the chinese system (if i remember my ancient chinese history correctly (and who doesn't? *laughsnort*) this was the Qing dynasty) produced a meritocracy where the best person for the job was the one that got it. however, as the form of the essay became more important than the content it actually produced something less than that.

really this is how i feel about things like resumes and cover letters and the such. these are all tools designed to assess how qualified a given individual is, and they do certainly do that to one degree or another. but the form is so prized over the function for many people that sometimes that just doesn't happen.

sure, a great cover letter that breaks all of the rules may float you to the top of any application pile -- but i think you're taking a pretty big risk when you do that. lots of places may simply not consider you at all just because your letter doesn't conform to what is expected and therefore required.

---------

i realize the above is something probably no one cares about. but if you have any thoughts on it id like to hear them. this is just something i was musing over on the drive to school today. am i wrong? is there room for new approaches in something like this that doesn't unduly jeopardize someone's employment chances?

sites that i have found to be awesome / useful in the last few days:

http://www.ringfo.com/

while shopping ever wondered if you could get it cheaper online but didn't want to have to go home to find out? this can help at least a little with that problem. call a number on your cell phone, enter the UPC number, wait and listen for the amazon.com price, the used prices, the amazon rating, and similar products. pretty rad.

http://www.google.com/intl/en_us/mobile/sms/index.html

yes, it's old. but it's still pretty neat. i saw it ages ago and forgot about it and found it again. most useful features? movie listings, directory listings and driving directions send to your cell phone in an sms.

http://www.jajah.com/

interesting idea. it's kind of like skype but you just use your regular old phone. i haven't actually been able to figure out how it's rates compare to a lot of phone cards (but i also haven't looked very hard).

anyway. that's enough. got anything of your own that's useful and/or awesome?
